Every year, almost 100,000 French trademark applications are filed with the Institut national de la propriété industrielle (INPI). At European level, more than 150,000 applications were filed with the European Intellectual Property Office (EUIPO) in 2024.
These figures testify to the very considerable interest shown by companies in this industrial property title.
Why register a trademark?
Registration with an industrial property office gives the owner an exclusive right to use the trademark to designate, in trade, the goods and services referred to in the application.
The owner is thus the only person who can use the trademark for these goods and services in the protected territory. He can therefore prohibit third parties from using this trademark to sell goods and services identical to his own and, under certain conditions, a similar trademark to offer similar goods and services.
A trademark is only protected in the territory of the office with which it has been registered. There are 3 levels of protection:

The French national trademark: the trademark is protected throughout France (excluding French Polynesia).

The European Union trademark: the trademark is protected throughout the European Union (27 Member States).

The international trademark: this is a simplified procedure which, following a single filing with a national office, enables a multitude of national titles to be obtained in the countries of the Paris Union or the World Trade Organisation.

Is it mandatory to use the services of a lawyer to register a trademark?
Although it is not compulsory to be represented by a lawyer when registering a trademark, it is strongly recommended for a number of reasons:

The lawyer will provide you with personalised advice on your filing strategy: he or she will check that the filing you are considering is suited to your company's commercial strategy.

The lawyer will assist you with the filing procedure: he will help you select the goods and services for which you need to file your trademark and will conduct the entire procedure on your behalf. This saves you time and reduces the risk of filing an inappropriate application.

The lawyer represents you before the INPI or the EUIPO in the event of difficulties arising during the registration procedure: opposition by a third party, request for observations by the Office, etc.
